The Basic Law botched its first real stress test during the Corona period with all sorts of fanfare: That is the thesis of the Bavarian lawyer Josef Hingerl. He sharply criticizes the fact that fundamental rights have actually been suspended. Or, as the President of the Federal Constitutional Court Stephan Harbarth said: “In Corona times, the exercise of fundamental rights sometimes happens in a different way than before the pandemic.” And further: “The basic rights apply, but differently than before the crisis.”
With refreshing humor, the lawyer from Bavaria, who has a doctorate, dissects all the madness of the Corona period from a legal perspective in the interview - such as the statement just quoted by the Merkel amigo at the head of Karlsruhe. With this unprecedented relativization of fundamental rights, Harbarth has opened Pandora's box, says Hingerl: "The government has "hijacked" the judiciary here, i.e. the judiciary.
